SureLC™ SaaS Privacy Policy

SuranceBay, LLC (“SuranceBay” “we” or “us”) gathers certain types of information in connection with your use of our SureLC™ SaaS platform.  The SureLC™ SaaS platform (formerly known as SureApp™) includes software modules such as SureLC™, SureLC™ DataLink, SureLC™ One, SureLC™ Compliance+, and such other modules as SuranceBay may add from time to time (collectively the “SaaS”). This document outlines the terms and conditions of SuranceBay’s privacy policy governing the use of our SaaS (“Privacy Policy”).  Specifically, it explains how we collect information from users of our SaaS, share your information, and ways you can limit our sharing of your information.  SuranceBay places the highest priority on protecting the privacy of its SaaS Users.  By using our SaaS, you (“You” or “User”) are accepting the practices described in this Privacy Policy.

OTHER TERMS / PRIVACY POLICY FOR CUSTOMERS
When you become our customer, you will communicate and exchange information, including personally identifying information, with us.   When forming a business relationship with us, a Carrier, Broker General Agency (“Agency”) and/or a Producer will be asked to enter into a Master Services Agreement and one or more Statements of Services with SuranceBay (“Services Agreements”) that will govern the use of specific SaaS modules.  The Terms of Use posted at SureLC™ SaaS Terms of Use and the Service Agreements may contain other privacy terms dealing with the use of personal information.   Service Agreements supplement, and to the extent of any inconsistency supersede, the general terms outlined in this Privacy Policy.  The terms of this Privacy Policy supplement, and to the extent of any inconsistency supersede, the terms of the SureLC™ SaaS Terms of Use.

Information We Collect

VISITOR DATA
We may collect, record and retain general non-personally identifiable data about you when you become a User of our SaaS including but not limited to your IP address, the type of SaaS modules you use, and the amount of time spent using various SaaS modules (“Visitor Data”). Visitor Data is automatically collected when you access our SaaS with a web browser.  We use Visitor Data to compile demographics, analyze trends and evaluate aggregate and individual statistical reports about our visitors and their uses.  SuranceBay does not disclose information that identifies specific users or transactions in the process of collecting or analyzing Visitor Data, except as more specifically discussed in the Personal User Information section below.

INFORMATION PROVIDED BY YOU
You may provide to us certain non-public information that is personally identifiable to you as a user of our SaaS in order for us serve you and/or grant you access to certain SaaS features (“Personal Information” or “PI”).  Examples of PI are your name, your social security number, your date of birth, and your driver’s license number.  In addition, you may provide us with publicly available information such as your e-mail, address or your insurance license numbers.

How We Use Your Information
Except as provided in this Privacy Policy, we will maintain the confidentiality of your PI and will not disclose it to third parties except as necessary to provide services to you. Third parties typically may include Agencies (if you are a producer), carriers, and your actual or prospective customers.  For example, we collect your social security number and date of birth to establish your account and crosscheck your identity with sources such as NIPR®.  Using this data, we obtain your state licenses and help you get appointed with carriers.   We will not use your PI for a purpose not previously identified without your consent.

Corrections To Your Information
Our SaaS relies on the accurate entry of your information or pre-populate your information from third party sources, such as NIPR®or your Agency (if you are a producer).  We urge you to verify the accuracy of your information and to update your data in the SaaS if something changes or if you believe it is incorrect or incomplete.  Except for your last name, date of birth or your social security number, you may modify information in your account settings yourself or by asking your Agency for assistance. For changes with your last name, date of birth or social security number please contact your Agency.

What Happens If You Do Not Provide Your PI or Withdraw Consent
If you do not wish to provide your PI, or if you withdraw your consent to our use of your PI, we will not be able to establish or maintain your account and you will not be able to use SaaS that requires the use of your PI.

Withdrawal of Consent to Use of Your PI
SureLC™ SaaS is designed to use PI as part of the verification, validation, crosscheck of identity, licensing and contracting process.  You consent to our use of your PI when you sign up to use our SaaS.   You may terminate your account at any time, however, we will retain your PI in the archives in accordance with our retention and disposal policy listed below.

COMMUNICATIONS INFORMATION
As a User, you may elect to contact us by sending us a question via e-mail, register for a service or webcast, request a call or otherwise communicate with us.  We may use such information to communicate with you, enhance our operations, offer you additional products or services, and better meet user needs.

AGGREGATE DATA
We may extract and aggregate information from Visitor Data, PI, Cookies, and other information collected, and use such Aggregate Data for internal and/or commercial purposes.

Tracking Technologies
SuranceBay uses technologies such as cookies, scripts or tags.  We may also use these technologies in analyzing trends, administering the SaaS, or tracking Visitor movement to gather user demographics.  We may periodically receive aggregate reports based on the use of these technologies for purposes of evaluating and improving our SaaS and services.

COOKIES
Our SaaS uses “Cookies” to help personalize your experience.  A Cookie is a small piece of data stored on your computer by your web browser.  Most web browsers allow you to disable the use of Cookies.  If you reject or disable cookies, you may still use our SaaS, however, your ability to use some features may be limited and you may not be able to enjoy full SaaS functionality.

IMPROVING OUR SaaS AND SERVICES
SuranceBay uses all information you provide to us in order to maintain and improve its SaaS and to enhance your experience.

DISCLOSURE REQUIRED BY LAW; PROTECTION OF SURANCEBAY
We will disclose your information, including Visitor Information and PI, whenever we, in our sole discretion, deem the disclosure to be necessary (a) to comply with a subpoena, applicable laws, or other legal processes; (b) to assist law enforcement officials or government enforcement agencies; (c) to investigate violations of or otherwise enforce our Terms, Policies, or Service Agreements; (d) to protect us from legal action or claims from third parties including you; and (e) to protect the legal rights, personal/real property, or personal safety of SuranceBay, our Users, employees, attorneys and/or affiliates.

SHARING INFORMATION WITH AFFILIATES AND OTHER THIRD PARTIES
Except as otherwise agreed in writing or stated in this Privacy Policy or our Terms of Use, SuranceBay does not sell, rent, or otherwise provide your PI to third parties for marketing purposes.  We use Visitor Information for data aggregation purposes that might be sold to other parties at our discretion.  Any such data aggregation would not contain any of your PI. We may provide your PI to employees, contractors, attorneys, affiliates or other persons or businesses that provide services to SuranceBay with regards to our SaaS (“Affiliates”).  Examples of Affiliates are payment processors, engineers, or programmers we employ.  Our Affiliates will only receive information necessary to provide the respective services and are ordinarily asked to sign confidentiality agreements limiting the use of such information. We will not be liable for any misuse of the information by Affiliates or third parties outside of our control.

TRANSFER & DISCLOSURE OF INFORMATION TO SUCCESSORS
If SuranceBay is acquired or merges, consolidation, liquidation or otherwise, in whole or in part, with another business that would take over offering our SaaS or similar SaaS to you, we retain the right to transfer your PI to the new business.  The new business would retain the right to use your PI according to the terms of this Privacy Policy as well as to any changes to this Privacy Policy as instituted by the new business.

EMAIL POLICY
SuranceBay will not sell, rent, or trade your email address to any unaffiliated third-party without your permission.  Depending on your server configuration, email to us may not be a secure communication method as it may be intercepted during transmission.  As such, you should not communicate to us non-public information that you feel is sensitive or confidential.  Please do not transmit by email to us sensitive information of a non-public nature, such as your bank account, credit card, or social security number information.  If you contact us and provide your email address, we may choose to use it to send you emails, including emails with promotional information about SuranceBay’s services, unless you have opted out of receiving such information.  You can change contact preferences at any time through your account.

PROTECTING YOUR CHILD’S PRIVACY
We want to protect your child’s privacy.  Our SaaS is not intended for use by children. As a parent or legal guardian, if you believe your child is using our SaaS without your knowledge, please contact us and we will help you resolve the issue.  Should we suspect that a child is using our SaaS we will delete the information as soon as possible and will not knowingly use or disclose it.   We will not be liable for the misuse of our SaaS by children.

LINKS TO OTHER WEBSITES
Our SaaS may contain links to other websites.  SuranceBay has no control over such websites you access such websites at your own risk and discretion. Other websites will ordinarily post their own Privacy Policy.  It is your sole responsibility to verify the privacy policies and other legal documents of other websites to understand how they treat your personal information.

Updates To Our Privacy Policy; Proprietary Material
From time to time, we will modify this Privacy Policy at our discretion.  The last update date is published at the beginning of this Privacy Policy document. We are constantly innovating and adding new SaaS modules. We supplement our privacy policy to reflect the innovations.  You should review our Privacy Policy frequently. When you use certain SaaS modules, you will see links to policies relevant to the particular SaaS module.  Please take the time to review all relevant privacy practices. The contents this Privacy Policy are proprietary to SuranceBay and its legal counsel, and may not be duplicated or otherwise exploited for commercial gain without our express, written permission.
